       The new bankruptcy law has added many requirements and procedures that must be strictly followed.  It will make the process smoother if you begin assemble the following items and prepare for the following duties:

Documentation:

     -   All pay stubs, pay advices or other evidence of salary, commissions or other income received within 60 days of filing the bankruptcy.  You will also need to prove what your gross income was for the past 6 calendar months.

    -   Assemble and retain all bills and other creditor correspondence, especially for the last 90 days, as the addresses and account numbers on these items must be used in your case.

     -  Tax returns for the past two years.

     -  Your credit report.  We can pull this for you when you retain us.

     -   Loan papers for secured loans such as mortgages and car loans.

Duties:

     -  Tax Returns - By about 20 days after your case is filed, you will have to have filed with the taxing authorities all returns that were due to date, and provide to the Trustee tax returns for the past tax year or a sworn statement as to why you do not need to file.

     -  Debt Counseling  -  You will generally need to complete an approved debt counseling course/briefing prior to filing, as well as an educational course before the case ends.  We can direct you to a source for these requirements.  ( See our Helpful Links page)
